The University of Phoenix is a for-profit university, founded in 1976 by John Sperling, that specializes in adult education in three modes: Ground (in classrooms), Online (a virtual campus), and FlexNet (a combination of the two). The university has been accredited by the North Central Association of Colleges and Schools since 1978. It is now the nation's largest private university, with about 230,000 students in 2004, more than half of whom were enrolled in its online campus. The university was investigated by the U.S. Department of Education during 2004-05 for its recruiting practices and for its student funding programs. In September 2004 the department reviewed complaints from 60 employees and former employees. Some of the practices were considered to be illegal or unethical. Reports indicated how admission counselors were sent to a glassed-in isolation room, called the Red Room where underperformers were put on display. The University of Phoenix settled out of court, paying $9.8 million.

In August 2005, Apollo Group was fined $343,000 for two federal violations that involved student funding programs. The Office of the Inspector General stated that the university improperly used funds creditting student accounts for fees on prior learning assessments. Another discovery was that it had issued funds to students enrolled in ineligible programs.
