Project Gutenberg Australia was the subject of some controversy in 2004 when the estate of Margaret Mitchell claimed infringement of copyright for hosting Gone with the Wind. As Mitchell died in 1949 her work was out of copyright in Australia, but not in the United States.

With the introduction of the U.S.-Australia Free Trade Agreement, works which are out of copyright will not reenter copyright, and thus can continue to be hosted on Project Gutenberg Australia. However newer works (those of authors who died after December 1954), will be subject to the newer laws.
