He played a bisexual character in the 2003 film Party Monster. In the deleted scenes of the film Saved!, Culkin kisses another actor on the set. This has further fueled rumors that he is gay, which he has repeatedly denied.

On September 17, 2004, Culkin was taken into custody in Oklahoma on complaints of possession of 17 mg of the controlled dangerous substance Xanax without a valid prescription and possession of 16 g of marijuana. Culkin has pleaded innocent to the charges and was released on a $4,000 bond. On June 8, 2005 Macaulay Culkin pleaded guilty to misdemeanor charges of possession of medication without a prescription and marijuana. He was given 1-year deferred sentences on each of the charges and was assessed $540 in fees.
