FedEx Ground differs from UPS in that its drivers are termed "independent comtractors", ie they are not employees. However in mid 2005, some 28 lawsuits were filed across the US, claiming that FedEx Ground maintained enough control as to render the drivers employees. This litigation may have a significant impact on income and organization of the Ground division of FedEx.
